TERMS AND CONDITIONS
STANDARD TERMS AND CONDITIONS OF SUPPLY OF GOODS AND SERVICES
1. Agreement to Terms:
By accepting and signing the quote or option sheet, the client agrees to engage Mr Glow Electrical (the Contractor) to perform the specified work under these Terms and Conditions. This agreement forms a legally binding contract in accordance with NSW law.
2. Payment Terms:
A minimum 50% deposit (progress payment) is required before any work commences. No materials will be ordered or labour scheduled until payment is received. For jobs exceeding the $20,000 threshold, progress payments will be detailed in writing.
3. Pricing:
Quoted prices include labour, materials, and GST unless explicitly stated. All quotes remain valid for 30 days. If scope of work changes after acceptance, a variation must be agreed upon in writing.
4. Cancellation & Refund Policy:
– 10% cancellation fee applies if cancelled within 48 hours of booking confirmation.
– 15% cancellation fee applies if materials have been ordered or partially fulfilled to cover sourcing, handling, and restocking.
– Once work has commenced, refunds are at the discretion of Mr Glow Electrical and only provided where fair and reasonable.
5. Warranty:
Mr Glow Electrical provides a 12-month warranty on workmanship. Manufacturer warranties apply to materials and devices installed. Warranty claims do not apply where damage or malfunction results from misuse, tampering, or external causes.
6. Compliance:
All work complies with relevant Australian Standards, Building Codes, and NSW Fair Trading requirements. Safety certificates are issued upon request where required.
7. Client Responsibility:
Clients must ensure safe and legal access to the site, and must disclose any known hazards, asbestos, or electrical issues prior to commencement. Any delays caused by site inaccessibility or unsafe conditions may incur additional charges.
8. Elderly & Vulnerable Clients:
By signing the quote or option sheet, the client confirms that they are capable of approving the work, have the capacity to make financial decisions, and that no Power of Attorney or legal authority applies. If concerns arise around decision-making capacity or undue influence, Mr Glow Electrical may pause or delay works until clarification is provided.
9. Communication and Legal Authority:
Mr Glow Electrical will only communicate with the person who accepted the quote, unless a legal Power of Attorney or Guardianship order is provided. Family members, neighbours, or co-owners are not considered parties to the contract unless legally authorised.
10. Dispute Resolution:
If a dispute arises, both parties agree to attempt to resolve the matter through open and respectful communication. If unresolved, the matter may be referred to NSW Fair Trading, NCAT, or a relevant court. Harassment, threats, or defamation will not be tolerated.
11. Ownership of Goods:
All materials installed remain the property of Mr Glow Electrical until full payment is received. We reserve the right to recover or disable equipment where invoices remain unpaid after 30 days.
12. Limitation of Liability:
Mr Glow Electrical is not liable for indirect, incidental, or consequential losses arising from the work performed, except to the extent required by law.
13. Acceptance:
By proceeding with the quote and/or making payment, the client acknowledges they have read, understood, and agreed to these terms and conditions.
